General Terms and Conditions

These Terms and Conditions govern all contractual relationships regarding orders placed on Estelle & Thild’s website, www.estellethild.com (below mentioned as ”Estelle & Thild” /”we” / ”website”).

Please read the Terms and Conditions carefully before placing any orders on www.estellethild.com.

Due to Swedish legislation we only accept orders from those over 18 years old. If you are under 18 years old you must have permission from a parent or legal guardian.  If you are under 16 years old you must let your parent or guardian accept Estelle & Thild’s privacy policy before you register to use this site or any of this site’s services. These Terms and Conditions may be modified from time to time. Users are responsible for keeping themselves updated with such changes.

If you do not agree to any changes of these Terms and Conditions, we kindly ask you to contact us immediately at weborders@estellethild.se Changes made after you have placed an order will not affect your order unless we are required to make the change by law.

In the event that an item is unavailable, Estelle & Thild will contact you shortly by phone or by e-mail. Estelle & Thild may, at any time, amend the content of the site. Although Estelle & Thild strives to display the correct texts, images and pricing on the site and web shop, errors may occur. Estelle & Thild cannot promise that the content of the site is free of inaccuracies or typographical errors at all times. If you have been charged the wrong amount in the web shop, Estelle & Thild will give you the option of placing a new order with the correct price or cancelling your order. All personal information, such as name, address and e-mail address, which you will provide when registering on the website or when placing an order with Estelle & Thild will be handled with utmost care and in accordance with EU law and in accordance with our PRIVACY POLICY.

The site may contain links to other websites beyond our reach. We cannot be held liable for content or privacy policies of such sites.

COLORS

We cannot guarantee that colors on the website will be true to life. This depends partly on the color settings of your computer and monitor.

FORCE MAJEURE

In case of Force Majeure, Estelle & Thild’s obligations will be suspended. The contract between you and Estelle & Thild can, in such cases, be partially or fully terminated by yourself or by Estelle & Thild. A Force Majeure is in the event of war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or Internet service, natural disasters or similar events. Estelle & Thild will under such circumstances do all we can to solve the matter for our customers as soon as possible.

GOVERNING LAW

These Terms and Conditions are in accordance with Swedish law.
The laws of your country may differ from Swedish law. Users should comply with all applicable local and international laws and regulations regarding the use of our website.

SHOPPING HELP

In order to make purchases on the Estelle & Thild webshop you will be required to provide your personal details. We ask you to provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide payment details that are valid and correct. Estelle & Thild reserves the right to delay any order if fraud is suspected, and also to restrict multiple quantities of an item being shipped to any customer or postal address.

PURCHASE

When you place an order on Estelle & Thild ‘s website you will receive an electronic order confirmation to your e-mail address. Before placing an order at the Estelle & Thild webshop you must agree to these Terms and Conditions. We cannot guarantee that all items shown at the Estelle & Thild web shop are available in stock at the time of your order. Some items might be sold out. If the item you have ordered is out of stock we will contact you by e-mail and you will be entitled to terminate your order and get all your money back. We will, without undue delay, give you a full refund within 30 days from when the order was terminated. Estelle & Thild may reject your order if we are unable to obtain authorization for payment.

PRICES AND PAYMENT

All prices displayed on the Estelle & Thild web shop are given in SEK, Euro, GBP, DKK, NOK and USD, VAT included. All transactions are made in SEK. As a customer outside Sweden, please note that the price charged from your account may differ somewhat from the Euro and USD price given, regarding to exchange rate fluctuation. If you have any questions regarding price, please contact weborders@estellethild.se. Please note that the shipping cost is not included in the prices displayed on the web shop. The shipping cost will be calculated and displayed at check out.

The shipping cost can alter depending on which country your order is being delivered to. Please view SHIPPING AND DELIVERY below for shipping charges. Orders outside the EU may be subject to VAT, import duties, and / or taxes, which are incurred upon receipt.

Estelle & Thild delivers your order according to Incoterm 2000, Delivery Duty Unpaid. This means that we do not collect VAT, duties, and / or taxes on orders to countries outside the EU. We are unable to specify the exact amount of duties and taxes you might have to pay for your package as these charges are decided by your local Customs. 

At the Estelle & Thild webshop it is possible to pay with VISA and MASTERCARD.

When you check out of the Estelle & Thild web shop your credit card will be charged with the amount of the purchased items and the shipping cost. You will then immediately receive an electronic order confirmation and once we receive the receipt of your payment the order will be processed and you will receive a shipping confirmation email once your order has been dispatched.

SHIPPING FEES

Deliveries within Sweden are shipped by PostNord.
Deliveries abroad are shipped by UPS.

Shipping is free on all orders within Sweden containing more than one product. Free shipping can not be combined with other discounts or offers.

To Europe the shipping costs is 69sek and 89sek for the rest of the world.

DELIVERY INFORMATION

During winter and summer holidays, all orders may take a few extra days before being processed and shipped. 

Sweden: PostNord 1-5 days

Europe: UPS 3-6 days

Rest of the world: UPS 7-14 days

Please note that delivery times are provided as guidelines only, not taking into account eventual delays.

UNCOLLECTED ITEMS

Items that are delivered by PostNord are retained at the local delivery office for 2 weeks. After this time the item will be returned to us. You will be charged for the shipping fees. Please bear in mind that you have to collect the item if you wish to use your right of withdrawal.

RETURNS AND EXCHANGES

Right to Cancel under the ICACRs

You have the right to cancel your order within 14 days without giving any reason.

The cancellation period will expire 14 days from the day after the day on which you acquire (, or a third party other than a carrier and indicated by you acquires) physical possession of the last of the goods.

To exercise the right to cancel, you must inform us by letter to: Notice of Contract Cancellation, Customer Care Department, Estelle & Thild AB, Artillerigatan 24, 114 51 Stockholm, Sweden or by email to: weborders@estellethild.se. 

For orders cancelled under the ICACRs, we will issue you with a full refund including the shipping cost paid by you. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make reimbursement without undue delay, and not later than:

(i) 14 days after the day we receive back from you any of the goods supplied; or

(ii) (if earlier) 14 days after the day you provide us with evidence that the goods have been returned; or

(iii) if no goods were supplied, 14 days after the day on which we are informed about your cancellation.

We will make reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the re-imbursement.

In the event that we have sent goods to you and you have cancelled your order, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent the goods back, whichever is the earliest. [If we do not receive the cancelled order back, we may arrange to have it collected from you at your cost.]

You shall return cancelled orders to, Estelle & Thild AB, Artillerigatan 24, 114 51 Stockholm, Sweden, without undue delay and in any event not later than 14 days from day on which you communicate your cancellation of the contract to us. The deadline is met if you send the goods before the period of 14 days has expired.

You will have to bear the cost of returning the goods.

COMPLAINTS

If you wish to address any complaints regarding the quality of your product or if the product is damaged upon delivery, please contact weborders@estellthild.se.We aim to help you as soon as possible. Please contact us as soon as you find any defects, so that we can help you.

In such case, please provide us with the following details:

• your order number;
• the product code/product name;
• details of the defect; and
• if you want a refund or replacement.

PRIVACY POLICY

When you register online with Estelle & Thild, use our online store or choose to submit for information in any other occasion, you give us your consent to process and use such submitted personal data in accordance with this privacy policy. This privacy policy applies to all protected personal information collected, maintained or used by Estelle & Thild.

Estelle & Thild collects personal data from visitors to the website who register their information or who use the online store. We do not collect or store any credit card information from our online customers.

If you are under eighteen (18), we require that you inform and get your parents or guardians consent before purchasing anything on estellthild.com.

If you give us your personal information, then with your consent, Estelle & Thild will use this information to keep you informed of our special events or promotions, to register you to our website, to administer our website services, and/or to process any orders you may place online. We may also use the information you provide to us to communicate with you about your order if you have placed an online order. We will send you announcements or communications by email only if you give us your permission to do so.

Estelle & Thild does not sell, rent or disclose our client’s names, addresses, email addresses or other personal information. Further, in order to maintain our website, to manage our database, to distribute e-mails and to provide client communications, Estelle & Thild contracts with selected third parties. These third parties, solely on Estelle & Thild ‘s behalf, may process the personal information you provide to us but we do not authorize any of these service providers to make any other use of your information. We do not otherwise disclose your information to third parties, unless we are required to do so by law or in connection with a legal claim or proceeding. However, the new entity will agree to protect the confidentiality of your personal information consistent with this Privacy Policy. Estelle & Thild uses appropriate security measures to protect the information you provide to us. However, while we take all reasonable steps to protect your personal information from unauthorized access, use or disclosure, you accept that no internet data transmission can be guaranteed to be secure from access by unintended recipients and will not hold us responsible for any breach of security unless this is due to our negligence. You are entitled to request access to and correction of all personal data you provide us, or to remove your name from Estelle & Thild’s marketing list at any time by contacting our customer service by emailing webshop@estellethild.se or mailing the address listed below. By accessing and using the Estelle & Thild website (including purchasing items through our website), or submitting personal information with Estelle & Thild sales, outlets or similar events, you consent to our collection, use and disclosure of your information as described in this privacy policy. Estelle & Thild reserves the right to make changes to its privacy policy or practices. We will post the updated policy on our website, and thus we encourage you to review this page from time to time, particularly each time you use our online shop.
